  • Fideicomiso (Bank Trust): The most common method for residential use. A Mexican bank holds the title as a trustee, but you maintain all ownership rights (use, rent, sell, bequeath) as the beneficiary. This requires a permit from the Ministry of Foreign Affairs (SRE).
  • Mexican Corporation: This is typically used for commercial investments and allows for direct ownership within the restricted zone but involves more complex tax and administrative obligations.

The notary or bank will apply for the necessary permit from the Ministry of Foreign Affairs (Secretaría de Relaciones Exteriores), which includes signing a clause agreeing to submit to Mexican law regarding the property.

These include notary fees, registration fees, transfer taxes, trust setup or renewal fees, and sometimes lawyer fees. Depending on which municipality your property is located in, closing costs can range between 5%–9% of your property’s value.

The notary registers the new deed and the associated fideicomiso (if applicable) with the Public Property Registry. This final registration process can take several months.
